The part that's most anger is that stupid bitch smiling after being called out face to face. What do you want to bet had she just apologized and gave the room back, he wouldnt have sought that cop out and tagged her.

stuff like this happens all day every day. Yes the car driver (senior) made a mistake and didn't realize it and frankly, probably didn't know what to do except smile (probably scared shitless). She didn't curse or yell at the biker. Yes an im sorry would have worked for me but i don't think i would have gone to that extent.... whats the cop going to do...reminder her to pay more attention ???? I would have handled it differently. shit happens.... remember that is someones mother ya know and no one got hurt, not even close
just my 2c worth

That was kind of a dickhead move on the biker's part IMO. I've seen way worse than that. There was no real immanent threat of injury there.

The deal is he had every opportunity to avoid a big issue, and he chose to be a dick.

I hope his grandma gets a tumor.... Ah shit, there goes my karma...

+1 with Gene on this one - he was being a dick. Plenty of room for biker to back off, or scoot in front, rather than make a big issue out of what was probably a genuine error - and we've all made them.

On a bike it is ALWAYS better to yield and live to ride another day. There is simply no joy in getting a ride in the back of a big van with big red 'n blue disco lights goin' nuts...

The joys of escalation.
From a riders and drivers perspective it is far better to have an idiot in front of you than behind you.
Then you can control time and space.
In this case I would prefer both in front of me.

I can see both sides. The biker was a dick, I would have cursed in my helmet and maybe give the finger to the bitch.
On the other hand, while this time no one was hurt in in imminent danger, I will bet a $1,000 that (a) this isn't her first time doing this, (b) had done worse to other bikers and cars, (c) will eventually cause harm, and (d) is a smug ass wipe that needs to be taught proper road etiquette. After all, she lives in CT and they drive like crap!

Why didn't she back off? The bike OBVIOUSLY had the the right of way. No question. His lane. Period. Maybe the fines will open her fucking eyes.

+1 Yes, maybe I would have handled it differently. But I have to agree, the fines, or at least the inconvenience of fighting the tickets in court, will hopefully make the driver more aware of their bad driving habits.

Doubtful that driver got any tickets for anything related to that maneuver ............Just sayin

When you post a video that shows you breaking the law at a specific time and location, you can be prosecuted, even though the person filing the charges didn't see the offenswe......and the evidence is available to the court .

Here , if the cop writes a ticket based on a go pro footage he sees there, there is no sworn statement filed in the court (the basis of every arrest) that says "I saw Glady's Kravitz commit a traffic infraction" that is the beginning of every prosecution, and no evidence that is admissible in court at that time.

If that cop wrote a ticket for something he didn't witness, and Mr Sensitive MC rider doesn't properly submit that video as evidence and just drives away, the cop has written a ticket for an offense he didn't witness, and has filed a sworn court information saying he did..Problem.

I'm guessing he pulls over the driver, checks her paperwork, writes any equipment violations he observes (possibly) and lets her go on any moving violation in regard to the minor road rage incident.

Some Police Jurisdictions like the NYS Troopers do write tickets for moving offenses that they did not witness based on physical evidence at the scene of accidents, so it is possible .

I'm thinking it's probably unlikely here that tickets for a minor violation that wasn't witnessed by the cop were issued here....Stop the incident from escalating, check all license information to insure compliance and suitability to drive, remind the party of the rules of the road, move on........

After the incident is posted on the internet, now the video is relevant, at the scene it's a crap shoot if it ever makes it into actual evidence. And it matters if that jurisdiction writes tickets for violations not actually witnessed by the officer filing that sworn information as a matter of practice .

Police use stoplight cameras all over the country. There are even speed trap cameras being tested (used?) in places. Video is good evidence.

And I really have a hard time believing the guys giving her a pass. As vulnerable as WE ALL ARE on the street this is an obvious case of someone either not paying attention or just not giving a fuck about a fellow motorcyclist when he is in plain view. Who also was not exceeding speed limits, changing lanes excessively, dude is just cruising with traffic.

They took out all the stoplight cameras in Los Angeles. Apparently they were more trouble than they were worth. IMO, we don't need a police state, or big brother spying the citizenry around, we just need the people to act right.

Maybe a warning from a police person is a good solution. Somehow I'm still not in favor of the biker running to get the cop, and then the "follow me" scenario... but it's a better solution than the biker getting in a scene with the old bat.

+1. There was a court action against them in a community here near Cincinnati (believe it was Lincoln Heights) which resulted in them removing the stoplight cameras and refunding the fines assessed against the "perpetrators". I know quite a few LEO's and have LEO's in my family and almost ball of them think they are either asinine or overreach their authority, ie are unconstitutional.

And again, evidence from stop light cameras is viewed and is available for prosecution purposes in court from an accredited camera that wasn't doctored.

Video can be total bullshit that gets the makers arrested for fraud like the infamous "Planned Parenthood videos"...Video for legal purposes usually needs to be vetted and accompanied by a sworn written statement to be usable in court.
https://en.wikipedia.org/wiki/Planned_Parenthood_2015_undercover_videos_controversy

A guy in the street showing a video of a violation to a cop , still means the cop didn't witness the violation and is using evidence to issue a summons..

And it's not evidence until it's available to the court....A guy that films something in the street could never follow up with that video and then the cop issued a summons not committed in his presence based on non existent evidence. So he wouldn't probably issue that ticket. It is possible that aggrieved biker follows the cop back to the Pct and downloads the video, it just isn't likely for such a minor transgression. When a store has video evidence of someone committing a crime, the store security first signs a sworn statement that they witnessed a clear violation such as a customer passing registers with merchandise before exiting the store, then video is obtained and secured as evidence. the arrest is still based on that sworn statement and the video supplements the case.....The system is set up for that .There is no mechanism for another driver to give sworn statements as to traffic violations before submitting a video as evidence.

In general, cops don't issue tickets for violations not committed in their presence and when they do, like at accidents, there is usually indisputable evidence that the violation occurred. Like an accident at an intersection where one car had a stop sign and the other didn't..It is obvious that the car failed to stop and yield right of way and we know the accident did in fact occur as based on an official accident report.

The statement from the Police you posted gives no indication that a ticket was issued, and just acknowledged that the cop was recognized for promptly coming to the aid of a motorist in a dispute.

And, I'm not even sure that's a violation as the car is clearly positioned ahead of the bike as they enter that merge. That means she entered the merge first. I back off there and let that car in.... Every single merge on every road where I live is like that with cars fighting for position....When you see a bike and continue as she did, I guess that can be construed as an unsafe lane change because of the risk of collision. Passing on the right? For merging at a designated merge? Ridiculous! That biker was a bit of a crybaby here.....

BTW, traffic red light camera evidence and speed camera evidence are only written to license plates, not individual drivers. Because that's all those videos show, the vehicle committing the violation.....

Wow. Did you watch the same video? The one linked in the first post of the thread? Let me ealk you through this. Motorcycle in lane that is not ending. Car in right lane that has to merge into motorcycle's lane. Car does not clear motorcycle but goes ahead and merges into lane that motorcycle occupies, not yeilding. Open and shut case. You really are an asshat. I honestly cannot fucking believe you posted that.......

Saw an update....Video was submitted to the Police..as I stated....

I disagree with the passing on the right ticket.....the very nature of a merge demands passing on the right , that's how cars merge.

Unsafe lane change..Ok..But the biker failed to yield to a vehicle that entered the merge before he did , and he refused to back off when he saw that and escalated the entire incident.

If you yield to the vehicle in the travel lane you need to pass nothing in a merge, let them go and slide in behind, and it goes smoothly, like a traffic circle. If it's working it works ok, maybe not great, but ok.

The merge "should" work like a zipper one tooth at a time. I'd bet we all have local merges where we know how it works, and can instantly spot a driver that's not familiar with it because of their actions. Also the driver that doesn't want to follow the 1 to 1 ratio by "squeezing in" screws up the process.

I the mornings do a 6 to 5 to 4 than a mile or so later a 3 to 2. Some days it goes smooth as silk, others, it's a neck twisting nightmare. Not so much based on volume but on driver skills.

The motorcycle DOES NOT HAVE TO YIELD! His lane does not disappear, it continues. The car's lane disappears and forces that lane TO YIELD! As a courtesy he could have yielded but the car was trying to be an ass and slip in front (like Glenn refers to). Basic rules of the road. Not even hard.......

She entered the merge ahead of the car......In a merge with traffic, you always pass on the right at a merge as traffic typically backs up in the travel lane before the merge....When a lane is closed on a limited access road, that lane often stops a mile behind the merge and cars on the right pass multiple cars before they merge.

The car that enters the merge first has right of way ..By your thinking, if multiple cars were merging from each lane and the car going straight hesitated moving forward because of inattention, only one car could legally merge from the right? No, If you get to the merge first the other driver should yield.. Most of the time with proper timing it works like a zipper with one car each but it doesn't have to when one guy is lolly gagging like the biker here..I'd argue he belongs over to the right since he's moving so slowly ,even that slow moving truck appears to be moving faster than him. I live in a congested area and have no patience for vehicles that fail to keep right and lollygag and don't pay attention to traffic flow.

Furthermore, look at this video as the biker moves with no degree of urgency while in the left lane. I think he belongs in the right lane where she is prior to this merge.....There is a mile between him and the car in front and even the slow moving truck is moving faster than he is..I don't want to be stuck behind him when I'm going to work and I'd move to get around him as well.

Once his horn is beeping and she squeezes him , and she continues that is a an unsafe lane change, but he should have backed off and clearly intentionally escalated the incident because he was working off the one car from each lane merge theory instead of the car that gets there first has the right of way. And he is driving painfully slow with no sense of urgency in that circumstance..What biker would have not passed that truck prior to that merge? He is sandbagging in the passing lane... And we don't know how far back he was doing that for.

His own stupidity and lack of anticipation of traffic flow, and misguided ideas as to where to where to position his vehicle caused this whole incident, and that woman was wrong to squeeze him once he lollygags his way in front of her..

She's got 2 moving violations, points, a few hundred bucks in fines, and likely 3 years of increased insurance rates.

All for not tapping the brakes and properly merging. But hey....she made it to YouTube.

That's a precursor to road rage, might want to get that in check.

Not having patience for the old, new, stupid, slow or just plain bad drivers is a way to get someone killed.

I see what you're saying and maybe that is what put me off of the biker's situation, it seems like he wasn't really taking ownership of his position in the merge until all of a sudden he was having a horn tantrum. When on a bike, you can't merge in front of a car by being at a driver's side or beside its rear bumper, you need to be slightly in front of it after all. The bike doesn't reach 6-8 feet forward of the driving position as most cars do, so basically the car was ahead the whole time, and the bike was not.

I don't think there is a hard and fast left-right-left-right rule to zipper merging, formally known as late merging. I think the biker is making that up or wishing it to be so. There are many articles on the web on the subject.

I still think after looking at the video, numerous times that he made a big deal over nothing in this case and perhaps he soiled his extra large diaper. He had the opportunity to do it differently and be safer than the course he chose, regardless of whether or not the other driver was wrong.

If it had been me on the bike, I wouldn't have even been there, as I ride aggressively and would have been in front of the bobtail truck before the merge. I also always avoid going along with traffic so people see me. Bikes traveling at the exact same speed as the car next to them are known to be almost invisible to the car's driver. Keeping your speed different than other traffic so they notice the motion is a much better and safer strategy.

Right, because cars entering the LIE (Long Island Expressway I495) have the right of way when they enter a merge lane. Rolling Eyes

Are they entering the road here? No ...Bad example....And when you do merge from the exit ramp and pull along side a car doing a steady speed it's on you to accelerate past him and merge in front OR brake and merge behind him..when you chose to accelerate past him and merge in front that means a cop should give you a ticket for passing on the right? Hardly.....That's just dumb...People pass on the right all the time in merges and it is perfectly acceptable and proper to do so.

How about when the right lane is closed ahead with signs warning you to merge, and you have to merge left, and traffic backs up in the middle lane? There is no passing in the right lane? You pass 50 cars while in the right lane until you get to the merge and the car that gets there first moves in and the other car yields.

I agree 100 % with Gene and maybe the perspective is different regarding merging when you ride in areas with traffic and congestion...That biker in this video is a tool. I agree 100% with the fact that the biker was just lollygagging along until the woman was going to pass, then he wanted to be in front ...Look at that video and tell me who here is behind that truck to even get in this situation? No one I've ever ridden with except maybe a new rider I was teaching how to ride that was overly cautious and unsure of their abilities.
